Solictor/Associate - Property Litigation

Job Introduction

The Leeds Real Estate Team, while dealing with all aspects of commercial landlord and tenant law,  specialises in contentious and non-contentious telecommunications advice. The breadth of the key clients’ estates provide a healthy variety of core landlord and tenant work, and the team undertakes cutting-edge telecoms work in the Upper Tribunal (Lands Chamber), acting in many of the recent precedent setting cases. Further work in the Tribunal and the Court of Appeal is ongoing. The firm is known to be at the very forefront of the telecoms real estate industry and works closely with some of the sectors’ leading counsel.

Our National Real Estate Team covers every aspect of commercial real estate work including planning and environmental, development, investment, asset management, funding, construction, landlord and tenant and dispute resolution. Clients include property management and development companies, health trusts and government bodies (local and central), owner occupiers and institutions, both in the UK and overseas.

Role Responsibility

The successful candidate should have experience in the following aspects of commercial landlord and tenant law:

  • Break notices and notices to quit;
  • Advice on the lease/licence distinction;
  • Drafting and service of S25 notices, S26 Requests and S29B extensions;
  • Drafting, issue and service of lease renewal/termination proceedings;
  • Advice on status of occupation after lease expiry.

The candidate should have experience of litigation and preferably be familiar with:

  • Civil Procedure Rules;
  • Upper Tribunal Rules;
  • the Drafting of witness  statements / statement of case ; and
  • Preparing Instructions to Counsel. 

The Ideal Candidate

An ideal candidate would:

  • Have previous experience in telecoms;
  • Be used to delivering concise commercial advice to clients. Have an ability to comprehend complex legal and technical issues and to explain these issues clearly to clients so that the clients;
  • Be comfortable with key date and tracker maintenance;
  • Have handled a workload in accordance with client protocols and with an appropriate level of supervision.

Key skills;

  • 2 to 5 years pqe in commercial property litigation (candidates with a litigation background in national firms will be considered).
  • Excellent relationship and client handling skills.  Able to deal confidently and professionally with clients on day to day issues.  Able to demonstrate a reasonable level of self-sufficiency, combined with an awareness of the boundaries of own competence/authority.
  • Change oriented with a positive, flexible approach towards the implementation of new initiatives.
  • Team oriented and collegiate with a willingness to share knowledge with and support other members of the team.
  • Exercise full compliance with DAC Beachcroft protocols on billing and credit control and demonstrate a high level of financial management in respect of own files.
  • Maintain and develop technical knowledge through attendance at training sessions, reading appropriate publications and exceeding Law Society CPD requirements.
  • Handle confidential data in line with the firm's data security protocols.
